Terms of Service

1. Acceptance

By creating an account or using CuliPulse ("the Service"), you agree to these Terms. If you don't agree, don't use the Service. CuliPulse is operated by CuliPulse, part of CuliOps ("we", "us").

2. The service

CuliPulse monitors the websites, APIs, network services, scheduled jobs, domains, DNS records and vendor status pages you configure, and notifies you about their status. We work to keep it reliable, but it is provided "as is" — we don't guarantee uninterrupted or error-free operation, and CuliPulse is not a substitute for your own incident response.

3. Accounts & eligibility

You must be at least 16 and provide accurate information. You're responsible for activity under your account and for keeping your credentials secure — including the API tokens and agent tokens you create, which work like passwords. Tell us promptly at support@culipulse.dev if you suspect unauthorized use.

4. Acceptable use

Only monitor targets you own or are authorized to check. Don't use the Service to attack, overload, or gain unauthorized access to any system; to break the law; or to disrupt the Service or other users. Don't resell, reverse-engineer, or abuse the Service or its agents.

5. Plans, billing & changes

CuliPulse has a free plan and paid plans. Plans differ in their limits — such as how many monitors you can run, how often they are checked, from how many places, and how much history the console shows — not in which features you can use.

Paid plans are sold through Polar.sh, which acts as merchant of record: Polar processes your payment and handles sales tax, and its buyer terms govern refunds. A paid plan is a monthly subscription that renews automatically until you cancel it. You can cancel any time from the Billing page; you keep your plan until the end of the period you've already paid for, and then your account moves to the free plan. If a payment fails and isn't fixed within 14 days, your account also moves to the free plan. Whenever your account moves to the free plan, any monitor set to check more often than the free plan allows is slowed down to the free plan's fastest check. Cancelling, or a failed or late payment, never causes us to pause or delete your monitors. We may change plans, limits, or prices with reasonable notice of material changes; changes don't apply retroactively to a period you've already paid for.

6. API, agent & shared links

You may use the CuliPulse API, the Terraform provider and the CuliPulse agent with your account. API requests are rate-limited per plan. The agent is open source under the Apache License 2.0 and the Terraform provider under the Mozilla Public License 2.0; those licenses govern the software itself, and these Terms govern your use of the Service it connects to.

Anyone who has a link to a report you share can view that report. Delete the report to switch the link off.

7. Availability & no warranty

The Service may change, be suspended for maintenance, or be discontinued. To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for losses from missed or delayed alerts, downtime, or data loss. Our total liability for any claim is limited to what you paid us for the Service in the 12 months before the claim.

9. Termination

You may stop using the Service anytime. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination your right to use the Service ends and we may delete your data after a reasonable period.

10. Changes to these terms

We may update these Terms. For material changes we'll update the date above and, where appropriate, notify you. Continuing to use the Service means you accept the updated Terms.
